Attorney & UPL Disclaimer

Effective date: February 2026

Read this before using Idaho Brief Formatter. This Service is a document-formatting utility, not a law firm and not a substitute for a licensed attorney. Every generated brief must be reviewed by a licensed attorney before it is filed with any court.

1. Not a Law Firm

Idaho Brief Formatter is a software tool. Its operators are not licensed to practice law in Idaho or any other jurisdiction and are not acting as your attorney. No use of this Service — including uploading documents, receiving output, or paying the download fee — creates an attorney-client relationship.

2. No Legal Advice

The Service does not provide legal advice, opinions, or strategy. It reformats and structures text you supply into a document that visually conforms to Idaho Appellate Rule 32. It does not evaluate the merits of your case, verify the accuracy of your facts or citations, or advise you on legal strategy, deadlines, or procedure.

3. AI-Generated Content — Verify Everything

The Service uses large language models to reformat and, in some cases, expand user text. AI output routinely contains errors, including:

  • Invented or misquoted case citations ("hallucinations");
  • Misattributed holdings or dicta;
  • Incorrect statutory or rule references;
  • Mischaracterizations of the record;
  • Omissions of dispositive facts or arguments.

You must independently verify every citation, factual assertion, and legal proposition in the generated brief before signing or filing it. Courts have sanctioned attorneys who filed AI-generated briefs without verification. Do not become one of them.

4. Unauthorized Practice of Law (UPL)

Preparing legal documents for others without a license constitutes the unauthorized practice of law under Idaho Rule of Professional Conduct 5.5 and Idaho Code § 3-420. This Service is intended for use by licensed Idaho attorneys and pro-se litigants preparing their own filings. Using the Service to prepare briefs for third parties as a non-attorney may expose you to criminal and civil liability. You are solely responsible for your compliance with UPL statutes and rules.

5. Attorney Duty of Competence & Supervision

Under Idaho Rule of Professional Conduct 1.1 (competence), 1.3 (diligence), 3.3 (candor toward the tribunal), and 5.3 (responsibilities regarding non-lawyer assistance), you must supervise all output from this Service as if it were prepared by a non-lawyer assistant under your control. Filing an unverified AI-generated brief may violate one or more of these Rules.

6. Rule 11 / IRCP 11 Certification

By signing and filing a brief, you certify that its legal contentions are warranted and its factual contentions have evidentiary support. Nothing in this Service satisfies that certification for you. Sign only after review.

7. Confidentiality

Text uploaded to this Service is transmitted to Google Gemini for processing. Do not upload material you are not authorized to disclose to third-party AI processors under your client agreement or the Idaho Rules of Professional Conduct 1.6.

8. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the output will be error-free or compliant with any court's local rules or judge's preferences.

9. Filing Deadlines

The Service does not track court deadlines. You are solely responsible for calendaring, complying with, and filing before all applicable deadlines under the Idaho Appellate Rules or any other rules that govern your case.

10. Acknowledgment

By using this Service, you acknowledge that you have read this Disclaimer, that you understand it, and that you will not file any generated document without independent attorney review.
